 Waumandee State Bank Online Banking Agreement



Waumandee State Bank requires that you change your password upon first use in order to protect the security and privacy of your financial information. In addition, you will be prompted to change your password on a regular basis to help prevent unauthorized or fraudulent use.


Important Information To Read Before You Begin: This information explains your obligations under the Online Banking Service Agreement. You should carefully read the following before accessing your accounts.


Authorization to Access Accounts: Online Banking is a service provided solely to Waumandee State Bank customers. Online Banking does not permit you to make electronic transfers to third persons. Access is limited to you as an accountholder and you are responsible for the Access ID and Password. However, we strongly suggest that you carefully protect your secure access at all times and change your Password on a regular basis to prevent any unauthorized access to your accounts.
Waumandee State Bank is not responsible for any mistake or loss resulting from your disclosure of your Access ID and Password. Any transaction performed through Online Banking by any person you authorized to have access to your accounts is legally binding upon you to the same extent that such transaction would have been performed by you in person, by mail, telephone, or other communication to the bank.
Business Days: Our business days are Monday thru Friday, except major holidays. Transfers initiated on a business day will be processed on the same business day until the cut-off hour of 6:00 PM Central Standard Time. Transfers initiated after 6:00 PM Central Standard Time on business days or on non-business days will be processed the next business day.
Account Access. You may use Online Banking, with your Access ID and Password to:

  1. Obtain specific account information such as: account balance, loan maturity dates and payment amounts, interest rate and interest paid year-to-date.
  2. View account activity such as: deposits and withdrawals that have posted to the account.
  3. Transfer funds between Waumandee State Bank accounts, specifically:
  • Transfer funds between checking accounts
  • Transfer funds between savings accounts
  • Transfer funds between checking and savings accounts
  • Make payments from checking or savings accounts to loan accounts with us
  • Get Information about balances in checking or savings accounts
  • View check images and deposit tickets
  • Use of Online BillPay
  • Retrieve Statements/Notices

Transactions Limits: You may use Online Banking to make an unlimited number of transfers each day from your checking account. Federal Regulations limit the number of transfers you may make from a savings or money market account to a maximum of six (6) transfers, including TeleBanc or Online Banking transfers, per statement cycle (month). Transfers INTO a savings or money market account (credits) are unlimited.

Online BillPay: Online BillPay is also available through Online Banking. To sign up, log into online banking and select the button for Online BillPay. We recommend all bill payments be scheduled at least five business days in advance of the due date presented by the payee. Bill payments scheduled before 1:00 pm Central Standard Time on a business day will be processed on that business day. Bill payments scheduled after 1:00 pm Central Standard Time will be processed on the following business day. If the Payment Date falls on a Sunday, or a Federal bank holiday, the Payment Date will default to the next business day.

E-Statements: E-Statements are available through Online Banking. To sign up you will need to review the E-Statement Terms & Conditions located at the bottom of this document and sign to verify understanding. Once signed, you will need to deliver the last page to any of our 7 locations or mail to an office. The addresses are listed in the 'Communications between the Bank and You' section below.

Customer Liability: If you believe your Access ID and/or Password has been lost, stolen, or otherwise become available to an unauthorized person, contact us immediately. The addresses and phone numbers are listed in the „Communications between the Bank and You‟ section below or email us at inquire@waumandeebank.com. The Electronic Funds Transfer Act states if you tell us within two business days of discovering the loss or theft, you can lose no more than $50 if someone used your Password without your permission.

If you do NOT tell us within two business days after you learn of the loss or theft, and we can prove that we could have stopped someone from misusing the information if you had told us, you could lose as much as $500.

Business account holders are not entitled to the rights provided to Consumer by the Electronic Fund Transfer Act and as such, the Electronic Funds Transfer disclaimer is not applicable to Business accounts.

Also, if your account statement shows transactions that you did not authorize, tell us at once. If you do not tell us within 60 days after the statement was mailed/e-mailed to you, you may not get back any money you lost after the 60 days if we can prove that you could have stopped someone from taking the money if you had told us in time.

If a good reason, such as a long trip or hospital stay kept you from telling us, we may extend the time periods.

Stop Payments: Your rights to stop payment and procedures for doing so. If you have told us in advance to make regular payments out of your account(s), you can stop any of these payments. Here's how: contact us at one of the offices listed in the „Communications between the Bank and You‟ section below, in time for us to receive your request seven business days or more before the payment is scheduled to be made. Give us your name and account number, the name of the person receiving the payment, the amount of the payment and the date on which it was scheduled to be made. If you call, we will require you to put your request in writing and get it to us within 14 days after you call.

Our liability for failure to stop payment of preauthorized transactions: If you order us to stop one of these payments seven business days or more before the transfer is scheduled, and we do not do so, we will be liable for your actual losses and damages.

Statements: You shall receive a monthly account statement displaying your online transactions unless there are no transactions that particular month. In any case, you shall receive a statement at least quarterly. If you choose to receive E-Statements they will be available for pickup within Online Banking. You will also receive email notification of any statements or notices.

Fees: Access to Online Banking is free to Waumandee State Bank customers. However, normal account maintenance and/or transactions fees may apply and you will be charged accordingly. If you forget your password please contact us at one of the locations listed in the „Communications between the Bank and You‟ section below.

Our Liability: If we do not complete a transfer to or from your account one time or in the correct amount according to the agreement with you, we will be liable for your losses and damages. However, there are some exceptions. We will not be liable for instance, (a) if, through no fault of ours, you do not have enough money in your account to make the transfer; (b) if the funds in your account are subject to legal process; (c) if the transfer system was not working properly and you knew about the problem when you initiated the transfer; (d) for errors resulting from any malfunctions of your browser; Internet Service Provider, computer, computer virus, or other computer equipment problems; (e) if circumstances beyond our control (such as fire or flood) prevent the transfer despite reasonable precautions we have taken; (f) there may be other exceptions, stated in our agreement with you.

In Case of Errors or questions about your electronic transfers, contact us at any locations listed in the „Communications between the Bank and You‟ section below, as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than sixty (60) days after we mailed/e-mailed you the FIRST statement on which the problem or error appeared. (1) Tell us your name and Waumandee State Bank account number, (2) Describe the error and the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information, (3) Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days.

We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or question. If we decide to do this, we will provisionally credit your account within ten (10) business days for the amount you think is in error, so that you will have use of the money during the time it will take us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not provisionally credit your account.

If we decide there was no error, we will send you a written notice three (3) business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.

Privacy: Waumandee State Bank will not disclose information to third parties about your account or the transfers you make except: (a) where it is necessary for completing transfers; (b) in order to verify the existence or condition of your account for a third party, such as a credit bureau or merchant; (c) in order to comply with government agency or court orders; (d) to our affiliates; or (e) if you give us written permission.

General: As a Waumandee State Bank customer, the account information and disclosure you received when you opened your account(s) remains in full force and effect. All of the bank's regular rules, restrictions, fees and charges will apply to all transactions you initiate while connected to your accounts.

Termination: Waumandee State Bank may modify, suspend or terminate your privilege of using Online Banking at any time, without prior notice to you. You may terminate your access to Online Banking by notifying us in writing at one of the addresses listed in the 'Communications between the Bank and You' section below.

System Requirements: What you need:

No Liability. We are not responsible for any error, damage or other loss you may suffer due to the malfunction or misapplication of any software or system you use, including, without limitation, any web browser, any internet service provider, or any equipment you may use, including, without limitation, telecommunications facilities, computer hardware and modem. You are solely responsible for the set-up and maintenance of your computer and modem. Except as specifically required in this Agreement or by applicable law, you agree that we will not be liable for any damage, whether direct, indirect, special or consequential or otherwise, including economic, property, personal, or other loss or injury, whether caused by hardware or system wide failure, whether due to a virus or other disabling routine, or otherwise, or resulting from the installation, use, or maintenance of the equipment, or other items necessary to access or use the Service.

Electronic Delivery of Statements and Notices
By completing the consent agreement you agree to permit Waumandee State Bank to make disclosures and provide notices to you in electronic form, instead of providing such notices and disclosures in written form. Your consent and agreement shall relate to all forms of disclosures and notices required under applicable law as a result of the various agreements between you and the Bank and shall remain valid until such time as you exercise your right to revoke this consent. You elect and authorize us, at our discretion, to electronically deliver your account statement(s) and notices that we are required to provide you under applicable Federal and State statutes and their implementing regulations, as amended from time to time. Other Federal and State laws and regulations ("laws") may be enacted or amended in the future to provide for electronic delivery of account statements and notices. Your election also authorizes us, at our discretion, to provide electronic delivery of such statements and notices pursuant to these laws after they become effective.

Terms and Conditions of Your Electronic Statement Agreement
By entering into this Agreement, you accept all the terms and conditions contained in the agreement. Please read it carefully. The terms and conditions of your Account Agreement and Disclosure for each of your bank accounts as well as your other agreements with the Bank such as loans continue to apply notwithstanding anything to the contrary in this Agreement. This Agreement is also subject to applicable federal laws and the laws of the State of Wisconsin. If any provision of this Agreement is found to be unenforceable according to its terms, all remaining provisions will continue in full force and effect. The headings in this Agreement are for convenience or reference only and will not govern the interpretation of the provisions.

Any waiver (express or implied) by either party of any default or breach of this Agreement must be in writing and shall not constitute a waiver of any other or subsequent default or breach. You may not assign this Agreement. This Agreement is binding upon your heirs and the Bank's successors and assigns. Certain of the obligations of the parties pursuant to this Agreement that by their nature would continue beyond the termination, cancellation or expiration of this Agreement shall survive termination, cancellation or expiration of this Agreement.

Definitions
"We", "Our", "Us" or "The Bank" means Waumandee State Bank. "You" and "your" refer to the account owner(s) authorized by the Bank to receive E-Statements under this Agreement.

"Account" or "accounts" means your accounts at the Bank. "Business days" means any calendar day other than Saturday, Sunday, or any holidays recognized by the Bank.

“Statement(s)” means a periodic statement or notice on the account.

Consent to Electronic Delivery of Account Statements
You have the right to receive periodic, printed Account statements mailed to your mailing address of record. By entering into this Agreement, you understand that the Bank will cease providing you with printed statements in the mail, and that all future account statements will be maintained on a website that you may access to obtain, review, print and otherwise copy/download your periodic statements. We will send a notice to you advising you of the availability of your E-Statement. You may then access your statement via a link to our website using the procedures we authorize. You agree to notify us immediately, in person or via U.S. Mail, of any change in your e-mail address. For your protection and for security purposes, we will not accept any change of e-mail address notices via e-mail.

You understand that if you decide in the future that you would like to receive printed statements in the mail instead of receiving E-Statements electronically, you agree to notify the Bank in person, via telephone, or via U.S. Mail. Our telephone number and postal mail address are listed in the section entitled “Communications between the Bank and You.”

Security
You understand the importance of your role in preventing misuse of your accounts and you agree to promptly examine your E-Statement for each of your Waumandee State Bank accounts as soon as you receive notification. You agree to protect the confidentiality of your account and account number, and your user ID and password. You understand that your user ID and password by itself or together with information related to your account, may allow unauthorized access to your account.

Periodic Statements
By enrolling to receive E-Statements, you will not receive a separate printed and mailed statement. Your E-Statement will be dated the day of the e-mail notifying you of the availability of your E-Statement (the "E-mail Date"). You must promptly access/review your E-Statement and any accompanying items and notify us in writing within the applicable time period specified in your Account Agreement and Disclosure of any error, unauthorized signature, and lack of signature, alteration or other irregularity. If you allow someone else to access/review your statement, you are still fully responsible to access/review the statement for any errors, unauthorized signatures, lack of signatures, alterations, or other irregularities. Any applicable time periods within which you must notify us of any errors on your account statement(s) shall begin on the E-mail Date regardless of when you receive and/or open the E-Statement. If you need to obtain a printed copy of a statement that has not been mailed to you because you have enrolled to receive E-Statements instead, please call any of our offices for a printed copy of your statement. A fee will be charged for this service.

Change in Terms
We may change any term of this Agreement at any time. If the change would result in increased fees for any bank service, or increased liability for you, we agree to give you notice at least 30 days before the effective date of any such change, unless an immediate change is necessary to maintain the security of an account or our electronic fund transfer system. We will provide any required notice of the change in terms to you by e-mail or by postal mail. If there is more than one party to the account, notice to any one account owner will be effective for all. We reserve the right to waive, reduce or reverse charges or fees in individual situations. You acknowledge and agree that the applicable deposit agreements and disclosures govern changes to fees applicable to specific accounts.

Disclaimer of Warranty and Limitation of Liability
We make no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, in connection with the E-Statements provided to you under this Agreement. We do not and cannot warrant that E-Statements will operate without error, or that E-Statements will be available at all times. Except as specifically provided in this Agreement, or otherwise required by law, you agree that our officers, directors, employees, agents or contractors are not liable for any indirect, incidental, special or consequential damages under or by reason of any services or products provided under this Agreement or by reason of your use of E-Statements, including loss of profits, revenue, data or use by you or any third party, whether in an action in contract or tort or based on a warranty or any other legal theory. Further, in no event shall the liability of the Bank and its affiliates exceed the amounts paid by you for the services provided to you through E-Statements.

Consent to Electronic Delivery of Notices
You agree that any notice or other type of communication provided to you pursuant to the terms of this Agreement, and any future disclosures required by law, including electronic fund transfer disclosures, may be made electronically via e-mail, notice with instructions/links or via an e-mail with attached disclosures. You agree to notify us immediately of any change in your e-mail address. We will send all notices, attachments and/or documents via e-mail to the last known e-mail address provided by you. You agree to notify us promptly in person, in writing (by letter sent via U.S. Mail), or by calling us at one of the above numbers if you do not receive The Bank‟s emails or of any change of your e-mail address. For your protection and for security purposes, we will not accept any change of e-mail address notices via e-mail. If you have not notified us in writing of any change of your e-mail address, you agree that your failure to provide us with a good e-mail address is the lack of ordinary care on your part. If we become aware that you are not receiving e-mail, we will send all notices, attachments and/or documents to you via U.S. Mail to your last address known to us. If your U.S. Mail address changes, please contact us for a change of address form.

E-Statement Procedures
You will receive an e-mail shortly after the end of each statement period (not all accounts generate monthly statements) with your E-Statement. You may link to the Bank‟s E-Statement site by clicking on the link in the e-mail. Clicking this link will take you to the Logon page for internet banking. You will need to enter your user ID and password to view your E-Statement.

Hardware and Software Requirements
We recommend Internet Explorer 7 or higher but can support any browser with 128-bit encryption capabilities (i.e. Netscape 4.03 or higher). To access, download, and print E-Statements, you need to have a personal computer with Internet and email access. You must also have Adobe Reader X or higher. Consent to Electronic Delivery of Promotions
You agree that any promotion or other type of communication provided to you by The Bank may be made electronically via e-mail, unless you specify in the opt-out section below. The Bank will not sell or distribute your email address to anyone outside of the bank for any purpose other than for its own promotional activities. You agree to notify us immediately of any change in your e-mail address. We will send all promotions, attachments and/or documents via e-mail to the last known e-mail address provided by you. You agree to notify us promptly in person, in writing (by letter sent via U.S. Mail), or by calling us at one of the above numbers of any change of your e-mail address. For your protection and for security purposes, we will not accept any change of e-mail address notices via e-mail. If you have not notified us in writing of any change of your e-mail address, you agree that your failure to provide us with a good e-mail address is the lack of ordinary care on your part.
